Blizzard, creators of the MMORPG World of Warcraft (WoW), have just won a legal battle surrounding the WoW MMOGlider software. The creation, made by MDY Industries, allows plays to automate many of the repetitive steps the video game involves, like attacking and acquiring loot.

The case was based on Blizzard's claim the company infringed its copyright, and the courts agreed it broke the license terms which players sign on for when they first play the game. Which part of the licensing agreement says you must attack all monsters manually and the like is beyond me, but I assume it includes something about forbidding the alteration of gameplay.

Like me, you may have been assuming the software was free, but it is not. Creator of Glider, Michael Donnelly sold it for $25 a copy, and moved more than 100,000 of them. That's about $2.5 million in revenue.

Blizzard will be pocketing about $6 million from the suit, but "experts" say damages could have been worse if MDY hadn't won some of its arguments about the damages in the court room. In any case, Blizzard can still appeal the ruling which threw out its claim to double or triple the cash settlement.

The case will go to court again in January, when the issues remaining to be resolved are expected to have settled. One issue is whether or not MDY broke the US Digital Millennium Copyright Act and whether the Glider creator will have to pay the money himself or not. Would not want to be that guy right now.

What is your take on this? Should he be sued? Should Blizzard have maybe partnered with him and used his software to meet the demand obviously a siginificant amount of gamers have for this sort of thing? Is it cheating, or cheap, or defeating of the purpose of playing a game?

Its funny how Blizzard only cares about MDY is because they made money. 10 bucks says that a program identical to glider is available for free somewhere and Blizzard turns a blind eye to that.

Well, considering they wanted to double or triple the awards, which were already double what he made..it sounds like they're just kinda greedy. Would like to get a comment from Blizzard on this though to see their side of it.

1) it most likely modified game scripts

2) the creator sold it for money even though WoW doesn't belong to him/her

3) it wasn't worth buying anyway

so yeah, i'm glad he got sued, you NEVER sell something you made/did not make if it is about a copyrighted product, it IS copyright infridgement so yeah, he got what he deserved, besides, making millions out of a program that makes it easier for you to play an online game is so cunning it becomes pathetic...

well i would, make it, that is, not distribute it all over the world and certainly not sell it for god's sake...especially if it was about a game as popular as wow....

Well thats what I mean. At least dont sell it. If its free and they dont like it I imagine a cease and desist order would be all that would happen.

I'm for programs like these because the creators are charging $15/month for repetitive, tedious, pointless tasks to progress through the game. The game isn't fun until you do tedious tasks, which is a bad formula IMO.

He didn't resell any of Blizzard's code. He entirely wrote the application himself.

Not to offend, but it is apparent you really don't understand what MMOglider did or how it worked.

I'd like to see the court's summary of how it is they said he infringed on Blizzard's copyright and what part of the EULA he violated. I don't play WoW anymore, but I did use Glider for awhile.

That much money would mean very little to Blizzard, they aren't exactly hurting. I would be pissed if I made a game and some kid came along and automated it... At the point when you can't even socialize with other players, it's just not fun anymore. Anyone remember Conquer Online? I can see it happening like that.

i figure. epic fail guy is right. blizzard wouldnt have cared so much if it were free. the fact that he is making money is all the reason. they dont care about receiving the 6 million. it wouldnt mean much to them. pocket change? just that some guy is making money off a game that isnt them.

I've been playing WoW for close to 3 years now and the one thing I hate the most is the endless grinding needed to level. When you thing about it its not just the character you level. There are the professions you choose leather working enchanting etc. in my opinion MDY Industries went wrong is charging the money for it.

It's because he sold it for money that allowed the infringement suit to succeed. WoW is the property of Blizzard, and customers have a non-commercial license to use the various API's, some graphics and other resources provided in the game. The moment you try to sell anything based off Blizzard's work without their permission ... you get taken to court.

I have to side with Blizzard on this one ... he shouldn't make a cent on this. If he gave the program away for free, then asked for donations, he probably would be untouchable ... or at least all they would do is ask him to stop.

You guys obviously have no clue.

There were serveral other 'bot' programs out there. Some free, some cheaper.

The difference? Glider has been virtually undetectable since it only reads the game data but never alters it. It mimicks the keyboard inputs, not data sent to the servers.

Blizzard has been unable to shut down glider and this action was the only way to do it. WoWSharp was detected and died. Several others have been detected and died as a result. Glider has had a few hickups, but as a whole never been detectable consistantly by Blizzard.
