Big brother can't track you in California.
A new Bill passed in California makes it illegal for store owners to track their employees with sub-dermal RFID tags.
Could you imagine this? You apply for a job at some big company or business, receiving the congratulatory 'Welcome Aboard!' and free tour to acquaint you with your new 9-5 surroundings. Next stop is the nurses office where someone will shoot a grain of rice sized capsule just under your flesh to allow your supervisor to track your every movement.
It is "the ultimate invasion of privacy," according to one California state senator who helped sponsor Senate Bill 362 which "would prohibit a person from requiring, coercing, or compelling any other individual to undergo the subcutaneous implanting of an identification device,".
State Senator Joseph Simitian, who had originally proposed this bill regrets that the RFID tag industry is not backing the proposal.
"I think it's unfortunate and regrettable that the industry hasn't come out in support of SB 362," he said in a statement after the bill passed the Senate. "I understand why we're having a robust debate about the privacy concerns related to RFID, but at the very least, we should be able to agree that the forced implanting of under-the-skin technology into human beings is just plain wrong. I'm deeply concerned that this isn't a given for the industry."
Despite the bill still needing to be signed into law, the hefty penalties for infractions should be enough of a deterrence. If any employer forces their employee to be tagged, that employer could face a $10,000 fine and a recurring fine of $1,000 dollars per day until the violation comes to a cessation with the removal of any RFID type device.
The bill has yet to state or make any reference to the external RFID tags that prisoners must wear, nor to the internal RFID tags that some pet owners will purchase for their pets. Furthermore, there are several bills in the works to further mandate a doctrine with regards to the privacy and security issues revolving around RFID identification.
RFID tags are a hot topic, and certainly not a new one. Back in 2005, a group of parents revolted in outrage when a school district in Sutter, California has proposed a plan to have all students in attendance wear RFID badges. The school district quickly recoiled and axed the program.
