Completely ridiculous. Definitely needs to be resolved or something. I understand this may be a desirable restriction for parents with children, but this should be configurable via the parental controls and respect those settings.

From what I've read its due to German child protection laws that prohibit adult content being downloaded in the day or something like that. I'm not sure if Nintendo is complying to this across all of Europe to simplify the rules their shop has to follow (one-size-fits-all) or if its due to Nintendo of Europe being based in Germany and thus their servers are subject to greater scrutiny by the law.

Either way this is incredibly stupid and I hope Nintendo does right by my European friends and gets rid of this restriction fast.

And I think this shows perfectly how Nintendo cannot pull off a hardcore console like the 360 or the PS3. They're trying too hard to cater to kids as well as adults, and the way that they're doing it just doesn't work. Microsoft has recently tried to create kid-friendly games with the Kinect with much success. The difference? Microsoft didn't sacrifice what mature gamers wanted for kids. What Nintendo needs to do is give parental controls to restrict kids (like the PS3 and 360) instead of restricting adults.

The way I see it: Nintendo = Disney, soft and doesn't want to have too much crude humore. Microsoft = Nickelodeon (including Nick @ Nite), light hearted, but is much more conscientious to everyone's need's.

They are worried about losing their image as a "kiddy" console, but at the same time they want to be show to a bigger audience that includes hardcore gamers. They need to balance it like Microsoft is, but Sony is going too hardcore.
