Tera developer battles NCSoft's attempts to block US launch
Trade secrets theft row travels to North America
It was revealed this week that MMO operator NCSoft filed a complaint in New York federal court earlier this month against Bluehole Studio, alleging the developer of Tera had stolen "copious amounts of confidential and proprietary" assets relating to the upcoming Lineage 3 for use in their own title.
NCSoft maintains that Bluehole, formed by its former employees, concocted a "simple and audacious" plan to "deal a crippling blow to their former employer" by producing Tera using work they produced while still employed at NCSoft.
NCSoft is seeking injunctions to block the North American launch of Tera, currently scheduled for later this May, as well as damages stemming from the alleged plundering of trade secrets. Naturally, Bluehole isn't taking any of this sitting down, and has vowed to fight back against NCSoft's latest claims:
"We are disappointed that NCsoft is attempting to mar the launch of Tera. Unfortunately we can't discuss much publicly due to the sensitivity of legal actions, but we do outright reject the NCsoft claims, and we are going to do everything in our power to defend and protect ourselves."
Latest claims are the keywords, as Bluehole has been stung in court by NCSoft over this as far back as 2009. While a previous ruling in South Korean court actually convicted Bluehole of the charges and ordered the studio to pay damages to NCSoft, the damages part was eventually overtuned during the appeal process. Bluehole continues to fight to appeal the other rulings.

You work somewhere develop something and get fired quit what ever and take your own work with you is kinda what happen here. But if
you Dev one way here more than likely everything you do after that
will be kinda the same, just maybe more advanced as you continue to progress. I will be playing Tera these are good developer regardless where they work.
Not to mention the overturning of that decision to fine Bluehole for damages? It sounds to me like there are definitely two sides to this story.
Do you have a source for that? According to Gamasutra, Tera is up and running in Korea. If this was the case as you mentioned shouldn't the game be shut down in Korea?
This is something that could easily cripple NCsoft they are basically having their hard work marketed against them as a direct competitor. Worse is TERA is out before Lineage 3 so if they fail this lawsuit they lose big time. This could not only jeopardise Lineage 3 but could jeopardise NCsoft's financial stability in turn putting sister company ArenaNet and game Guild Wars 2 at risk.
I was actually thinking of trying this, but if it really is a clone, I'll skip out on it.
