Even if it does affect CoD:MW3 I wouldn't doubt that they'd still try to bring it out on shelves. either way if MW3 is made or not it doesnt really matter to me.

What does activision deserve ?

Activision stopped behaving good with paying royalties already after COD4, there was an argument which is still very private, Co-Founder Grant Collier left IW and erased him self from gaming industry.

That's why MW2 was a crap PC game, they did it on purpose to make a mess on the way out. And they did it well, it was a huge cluster*bleep* of Activision's company image, and it should be, activision doesn't pay royalties IW deserved and owned by the private contract named "Memorandum of Understanding" which is a special contract that is usually made for specific employees on a personal level, so Activision bought IW in 2003, that's because IW sold it self out, Activision was very friendly company at that time, same bobby kotick guy.

The contract between IW personell and Activision stated multiple stuff (which we may never know in fullnes) including that IW employees are subject to royalties of "percent of sales", "percent of derivative works sales", "engine royalties" (this means IW should have got royalties off sales of Call of Duty 3, Call of Duty 5 and Call of Duty 7 ... yes, even if they didn't make the game, but Treyarch was always using IW Technology(engine)
However Infinity ward/Activision must pay some engine royalties to IDSoftware because IW Engine was made from IDTech4 (COD2) / (COD1 used IDTech3)

If you have a retail copies you can see in the back of the case in small text it says "This Product contains software licensed from ID Software ("ID Technology"). C 1999-2007 ID Software, Inc."

That's why you see Carmack always in a great mood, call of duty is not "taking a share off ID software's genre" ... they're guietly getting their share for every copy of COD you buy.

Valve's Source is an modified IDTech3 too, i don't know what kind of relations hip those two now have, cause Q3 code went opensource - there is no IDsoftware notice on Portal 2

It might also be the case that IDSoftware just wasn't as evolved at the time to operate strictly , which Valve snatched GoldSrc , but Carmack Still mentions other licencees.

Even if the royalties case is won by Activision, that still doesn't mean it's not a gaming company I despise. They milk the crap out of the same few games by adding the same stuff with slightly better graphics every few months, not helping with the creativity process of wannabe designers. The addons are weak at best whith only a few extra maps. How CoD could potentially require a fee just to play online, which is pretty much the entire game itself, on top of the game itself is just sick if I;m on a good day. The second one of it's milked cows makes a loss, they sell the dam investment just like that. How many gaming companies do you know seriously blow cash on advertisement outside of the normal gaming media. The dam bus I go on still has a black ops ad on it months after it's release. Greedy douces only profit from the exposure their games get, not the quality. What they sell isn't video games, it's profit for shareholders which mainly go to the CEOs anyway.

Capitalism is great. Crime is not. If someone is found guilty then they should pay. Activision is guilty of nothing until it goes to trial. If you argue this, than should turn your judgement on yourself. Like that ounce of weed you got under the bed?! Yeah, so my point is be patient and spend your money how you like without raising blood pressure over fruitless things.
