How loose is loose? There is supposed to be a little wobble in it (to absorb impacts and such).
When opened fully (so that it clicks in place) the top edge of the top screen should have about 3mm or so of play in it.
If yours moves by appreciably more than that, then you should see about taking it back to where you bought it. If you explain to them what the problem is then they should give you a replacement.

i bought my 3ds cosmo black yesturday and i noticed the hinge is a bit loose idk if thats going to cause any issues wat i should do with should i get a replacement
