Interplay v. Bethesda Case

Looks like Bethesda isn't liking the fact that Interplay is still selling their "Fallout Trilogy". More news, including the source, here. Care to discuss?

Isn't it deeper than that? I though it was to do with Interplay not making the MMO in time. Or am I mistaken?

When Bethesda made F3, they signed a contract with Interplay that said Interplay couldn't start making anything to do with the series. Interplay had been making the 'Fallout Trilogy" before the contract was signed, so they kept selling it because the contract had nothing to do with products they were already making. Bethesda is trying to sue Interplay for making putting the Trilogy up online and that they hadn't been making it before the contract, despite Interplay having plenty of proof. It's all in the link

Not the way I read it.

Interplay are trying to play off FALLOUT 3's success in the new generation of consoles. They can't, they signed a contract.

Correct me if im wrong because im only new to the Fallout series but isn't Fallout 3 the third in the series, and trilogy means 3. And another companies selling the trilogy even though part 3 they don't own. Of course bethesda would be *bleep*ed off.

Fallout 3 isn't the third in the series. The trilogy contains F1, F2, and F: Tactics.

Tactics was made way before the contract, as were all the games in the set. The reason Bethesda is mad is because they started offering the same product that they had been selling, online.

Talk about missing the point

Bethesda and Interplay entered a deal in 2004, the original deal stated that Beth Soft had the rights to make Fallout 3 and in future use the Fallout name for future games and franchises.

Since Beth Soft are actual fans of Fallout and Interplay's work, they gave the dying company a second chance and a second wind by making them a second deal, which was, they had a deadline to produce material for a Fallout MMO, which would be published by Bethesda Softworks. This would result in funding from Beth Soft and allow Interplay to be rid of the bankruptcy that has stopped them making any more games.

The deadline passed and Interplay produced nothing, instead they re-sold the previous Fallout games (Fallout 1, 2 and Tactics) as the "Fallout Trilogy", which made players believe that the trilogy included 1,2 and Beth Soft's 3.

Not only that but Interplay also went behind Beth Soft's back and began to sell the previous games on Steam and other digital download sites, which breached the contract that they made with Beth Soft.

This isn't about Beth Soft after money (in a sense, yes because every company is after a profit and making money) but they aren't purely after the money. This is all about a company breaching a contract that they signed and making money off another companies' success, in which Beth Soft want the full rights to Fallout as compensation.

Also Hitman, while you are entitled to your opinions, it seems your facts about all of this are skewed. Beth Soft aren't mad about Interplay offering a game using the same franchise to promote/make a game online because they are the ones that approved it. Might be worth researching before stating your opinions as facts
