You don't know what you are talking about. Basically, "homebrew" is a term used to describe user made software ran on consoles. Homebrew it itself is not illegal (unless maybe it does violate Nintendo's EULA), but it can be used for illegal things (like downloading VC games or ROMs for free). A lot of the applications though are user-made and free to the public. 	You are pretty much screwed. You are going to have to do some deep searching to see if someone found a way to get around it for those who don't have homebrew yet and are on the latest update.

If anything, it's the opposite. I haven't done homebrew in quite some time and last time I actually got into homebrew, it was when the 3.4 update came out, so all of my knowledge of homebrew is when the 3.4 update came out.

	You don't need to edit it, the theme is distributed as a package. (editing it yourself if complicated anyways) A few minutes of Googling can find you the website.
